Respect for privacy and confidentiality is an important concern for Alia (hereinafter "Alia ", "we", "us" or "our"). For this reason, Alia ensures that effective controls are in place to protect the confidential nature of the personal information in its custody.

This Privacy Policy (the "Policy") describes how Alia collects, uses, discloses and stores personal information that you may provide in connection with your use of Alia (the "Website") or the services and/or products provided by Alia . It also informs you of Alia 's commitments regarding the management and protection of personal information.

By accessing this Website or using our Services, you consent to the collection, use, disclosure and storage of your personal information in accordance with this Policy.

1. Who are we and what do we do?

Alia was born out of a clear mission: to bring people closer to healthcare professionals by offering them centralized access to care and medical follow-up.

By combining telemedicine and care monitoring, Alia facilitates continuity of care and supports a truly personalized approach. Technology supports the relationship between patient and professional, without ever replacing it.

Alia acts solely as a platform provider facilitating access to services and does not act as a healthcare provider or custodian of personal health information. Thirdparty telehealth providers, including Maple, and their licensed healthcare professionals are independently responsible for the delivery of healthcare services and compliance with applicable healthcare and privacy laws.

2. Who is the Policy aimed at?

This Policy applies to anyone who communicates or interacts with us by any means, whether you are a client or someone who uses our platforms or services. Our employees and those who respond to our job advertisements are subject to a separate privacy policy.

3. What is personal information?

This is any information about a natural person which, separately or in combination with other data, makes it possible to identify that person. This may include, for example, your name, e-mail addresses, contact details and similar information provided to Alia . Such information is not considered personal information when it is aggregated and cannot be associated with an identifiable individual.

This non-identifiable information is used for system and Website administration purposes, to better understand your interests and to improve the site.

Electronic communications - If you provide your e-mail address, Alia may, from time to time, send you commercial electronic messages in the form of e-mail, in particular to inform you of our offers, important updates, or to offer you a new service or product, including those offered by entities belonging to the same group of companies.

  • health intake information;
  • symptoms, concerns, or treatment-related information you choose to provide;
  • appointment booking and consultation-related information;
  • prescription-related information;
  • lab requisitions, lab results, or related documentation;
  • communications submitted through the platform in connection with healthcare services; and
  • other information necessary to facilitate access to telehealth or healthcare-related services.

Health-related information is treated with an elevated level of sensitivity and is handled in accordance with applicable privacy laws and contractual obligations, as applicable to the role of Alia and the third-party providers involved in your care.

6B. Role of Alia and Third-Party Healthcare Providers

Alia acts as a platform provider that facilitates access to healthcare-related services and technology tools. Alia does not provide medical care, medical advice, diagnosis, or treatment.

Healthcare services made available through the platform are provided by independent third-party telehealth providers and licensed healthcare professionals, including but not limited to Maple and its affiliated clinicians, who are independently responsible for the delivery of healthcare services and for compliance with their own legal, professional, regulatory, and privacy obligations.

Where applicable, healthcare providers or provider organizations may collect, use, store, disclose, and retain personal information or personal health information in accordance with their own privacy policies, professional obligations, and applicable laws. We encourage users to review the privacy practices of any third-party healthcare provider involved in their care.

6C. How Health Information May Be Used or Disclosed

Where applicable and permitted by law, health-related information may be used or disclosed for purposes such as:

  • facilitating access to telehealth or healthcare services;
  • coordinating appointments, consultations, referrals, or follow-up care;
  • supporting treatment, care navigation, or related service fulfillment;
  • enabling payment, billing, or administrative processing where applicable;
  • maintaining platform functionality, service operations, quality assurance, and support;
  • complying with applicable legal, regulatory, professional, or contractual obligations;
  • responding to safety, fraud, misuse, or security concerns; and
  • any other purpose permitted or required by applicable law.

Alia will only access, use, or disclose health-related information to the extent reasonably necessary to provide its platform services, support legitimate business operations, comply with applicable law, or as otherwise authorized.

Subject to applicable laws and the role of Alia versus the healthcare provider involved, you may have rights regarding your personal information or personal health information, including the right to:

  • request access to your personal information or health-related information held by us, where applicable;
  • request correction of inaccurate or incomplete information;
  • withdraw consent to certain uses or disclosures, subject to legal or contractual restrictions;
  • request information about how your information has been used, disclosed, or communicated;
  • submit a privacy-related question, concern, or complaint; and
  • be notified where required by law in the event of a privacy incident involving your personal information or health-related information.

Please note that in some cases, requests relating to medical records, clinical notes, prescriptions, or provider-held health records may need to be directed to the independent healthcare provider or telehealth partner responsible for your care.

6E. Safeguards for Health-Related Information

We apply administrative, technical, and physical safeguards appropriate to the sensitivity of the information we handle, including health-related information, in order to protect it against unauthorized access, use, disclosure, loss, theft, or modification.

Where personal information or health-related information is processed by third-party service providers or telehealth partners, we take reasonable steps to ensure such relationships are governed by appropriate privacy, confidentiality, and data protection obligations, where applicable.

If you have questions, concerns, or complaints regarding how your personal information or health-related information is handled, or if you would like to exercise your privacy rights, you may contact us directly

7. With whom is personal data shared?

We cannot communicate to a third party the personal information contained in the file we hold on you, unless you consent in writing or if the law so provides (in the case of an investigation by judicial officers, for example). In particular, we may communicate to a third party the personal information contained in the file we hold on you if this communication is made for the same purposes.
Any personal information concerning you that is sent outside Alia is sent in such a way as to ensure confidentiality, even if you are the recipient.

Disclosures to our service providers - We may also share your information with third party suppliers, consultants and other service providers we employ to perform tasks or services on our behalf. These entities include, but are not limited to, our payment processing providers, web analytics companies (e.g. Google Analytics), business intelligence service providers, email service providers (e.g. Mailchimp), and advertising partners.

Disclosure to government agencies - We may disclose your personal information to government agencies that are authorized by law to obtain the information, or where Alia has reasonable grounds to believe the information could be useful in the investigation of unlawful activity, to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records or information, or to protect the rights or property of Alia.

Business transaction - If Alia undergoes a merger or other reorganization, it may disclose your personal information to the resulting organization.

8. How is personal information protected and stored?

Retention - The personal information we hold about you is kept in an electronic file, the purpose of which is to enable you to benefit from the services offered by Alia and complementary services.

Security - We take and apply the necessary and appropriate security measures to ensure the confidentiality of the personal information in our possession, to protect it against loss, destruction, theft, as well as against unauthorized consultation, communication, reproduction, use and modification. The personal information contained in the files is therefore accessible only to those persons who need to know it in the performance of their duties and who consult it only when necessary.

Nevertheless, due to the nature of the Internet and the technologies it supports, the risks associated with security and confidentiality cannot be eliminated and Alia cannot guarantee that your personal information will not be disclosed in a manner contrary to the provisions of this Policy.

As far as possible, we ensure that the personal information contained in the file we hold on you is up to date before using it to make a decision that concerns you.

Personal information, and where applicable information handled by third-party service providers, may be stored or processed outside of Canada and may be subject to the laws of those jurisdictions. We apply administrative, technical, and physical safeguards appropriate to the sensitivity of the information to protect it against unauthorized access, use, or disclosure. In the event of a privacy incident involving personal information that poses a risk of significant harm, Alia will comply with applicable legal requirements, including notification to affected individuals and relevant regulatory authorities, where required.

9. What are your rights with regard to your personal information?

Right of access, amendment and deletion

By contacting Alia at administration@aliahealth.cayou can:

  • Request access to your personal information and obtain information about Alia's collection, use and disclosure of that information;
  • Request to change or update your personal information; and
  • Request that your personal information be deleted.
  • Subject to certain exceptions prescribed by law, you will be given reasonable access to the personal information we hold about you and will be entitled to challenge the accuracy and completeness of that information and have it amended as appropriate. You can help Alia maintain the accuracy of your information by notifying Alia of any necessary changes.
  • If you request the deletion of your personal information, your request will be processed in accordance with applicable laws. Please note that Alia may still retain some of your personal information in order to comply with its legal and regulatory obligations or if it is still necessary for the purposes for which it collected it.

In accordance with applicable Quebec privacy laws, including Law 25, individuals have the right to request information about how their personal information is processed, including whether it is communicated outside Quebec and the categories of persons who may have access to it.

Refusal and withdrawal of consent

If you refuse to provide us with your personal information or to give us the required consents, we may not be able to do business with you or provide you with the requested services.

- At any time, you may request to be removed from our promotional or marketing electronic communications mailing lists by unsubscribing from our e-mailings.

How long is personal data kept and how is it destroyed?

We retain your personal information for as long as we have a legitimate need to do so. Even if you have ceased to do business with us, we must retain certain information because, among other reasons, it is required by law. When this information is no longer required, it is destroyed. As part of the process of destroying information, we observe strict rules and also take care to prevent any unauthorized person from gaining access to it.
